Latest legal issues

The alleged role of minor and assault in Delhi gang rape case demand a new reform for redefining the age of juvenile in our legal system but argument is laid that especial laws should be made to treat juvenile crime in our country:-

The debate over the alleged role of the juvenile in the recent rape and murder case rage the capital even today, at the heart of the contention is that one out of the six accused  of is a minor and should be treated as an adult keeping in mind the gravity of offence

Juvenile

committed by him, the controversy over the juvenile demands for redefinition of the age in criminal cases. A s of now the accused below the age of 18 is considered to be a juvenile and is treated under juvenile justice Act, the legal definition of juvenile is found under section 2(k) of Juvenile justice (care and protection) Act, 2000, which states a juvenile or ‘child’ means a person who has not completed 18 years of age.
The age of adulthood for male in India was set 16 earlier, but later India redefined the Convention on the Right of child in 1992, and in the subsequent drafting of the JJA in 2000, it was raised to 18.“The age of 18 was set based on consensus among countries as large majority had set the age of maturity at 18. This is also based on specific development stage of child”, says Vandhana Kandhari, child safeguard expert Unicef India.
As the rape and consequent death of the sufferer, there has been an outcry for lowering the age to 16.On Monday supreme court agreed to look into the petition filed by two lawyers  that seek to lower the age of who would be considered juvenile to from 18 to 16, a complete reversal of change that took place in 2000.But not everybody is convinced that lowering the age would be a wise move. Many, on the other hand hold that if judged as juvenile the accused would get away with a milder punishment that is of three year of imprisonment in Remand House for what is clearly a heinous crime...As an Adult under the law he can get up to Death sentence, as a minor he will at most get three year jail in reform house, and then be monitored on his release.Considering the difference in punishment, there is demand from some quarter that a accused be tried as an adult, but Indian law doesn’t allow such exception to be made. At the best, one can consider a clause in section 16(1) in the JJA, which says that if a minor above the age of 16 years commits a crime that the juvenile justice board feels is “ of so serious in nature or that his conduct and behavior has been such that it would not be in his interest or the interest of the other juvenile in conflict with law to be kept in such place of safety and in such a a manner as it think fit shall report the case for the order of the state government”.
Legal Expert also stress the one particular incident, how monstrous, cannot be the basis for the change in law. Some also voice that the fear that sending 16 years old convicts to jail- as opposed to reform homes where they are placed when a crime has been proved- can turn them into hardened criminals.Assuming that the person at the age 16 is sent to life imprisonment, he would be released sometime in his 30s.In this case there would be little assertion that the convict would emerge as a reformed person, who will not commit the same crime that he was imprisoned for.The Juvenile Justice Board is staffed with competent people who can examine the detail of a particular case and come to a conclusion whether exception should be made. We are reformative country and should attempt to reform people, lowering the age will not solve the problem it encourage the child to get sucked into criminal life. This is 21st century and we should give one chance to change according to singh.

  CAREER IN LAW

This piece of writing (Article) is particularly projected to be studied by those students who desire to do something different from the popular field of Engineer, Doctor or Commerce after completion of their ISC. The rising Indian city middle class family has engaged themselves into this age old fire struggle race of forcing their children’s to do B Tech or to do MBBS.  The reason behind is established thousands of college related to these field offering these course, with availability of numbers of college in these filed an average student gets into these college and come out with a degree of B. Tech

career in law

In order to have a secured future and get a good a salaried job parents our hindering the personal and professional growth of children’s. The passion, the desire to have a sense of achievement is lost people our running for money and not their passion. The reason students knowing that their our number of It company in our country and world through who will give them job which will pay them a package of 2lakh

Law as a career is looked down upon, people thing who doesn’t have any work those people get into law, but that’s not true, law demand great efficiency and hard work, it is the day and night work of the advocate which leads to a client winning a case. In our present century law is just not limited tone particular field eg.litigation, wide variety of option are available such as Media law, company law, labour law,IPR. With the emergence of top National law school in our country things have changed further. National law school helps in over all development of law student, leads to exposure national & international, which helps in overall personality development of student, getting a law degree from any law college will not lead top personality development that why it is important that one should give best effort clear CLAT and get into any of the top National, law school.

We will know highlight the number of option that is available after completion of law course, important for those who’s thing law has limited scope

1.1.      A Practicing Advocate:
There is nothing to be explained with respect of this profession. This is the conventional route people adopt after their graduation in law. I will recommend this career for those who already have someone in their family members as practicing lawyers or judges. Indian courts just  function like  sabzi mandi (this was stated by one of India's most eminent jurists M C Chagla in his autobiography) leaving a less scope for the first generation lawyers. Even if you are diligent and competent of moving things your way, you will be only into your 30s when your pocket will be filled up with client fee and table, full of case files. Many would challenge my argument stating it as negative, but ground reality cannot be usurp by misguiding untrue, optimism. Thus those who have lawyers in heredity should definitely go for court practice because their clients is already stable and they will be inherit an already reputable name.
Litigation as a career is one of the most common route that law graduate opt for, but this route will be best for those who have a lawyer in their family or have close connection with lawyers. Litigation or practicing law has less scope for first generation lawyers, even if you are hard=working, dedicated, sincere have the capacity to work things out. You will have clients and money only when you reach the age of 30. But those who have law as a family background should opt for this profession as they all ready have their clients and they will inherit the popular name of their family.

2. Corporate Counselors:

corporate
Present generation have a phobia of corporate world, there is craze for these big corporate firm as they pay good package,  it has now become a new career option for young lawyers, student have fascination toward these big co-operate house. The corporate firm are rising it is when a small group of student from National law university pass out and open a law firm and provide legal service to some other company, these company pay huge amount of money to the firm providing legal service. The corporate industries are getting specialized in several other fields like, Intellectual property right, Merger Acquisition of a company, Insurance etc.

3. Civil Services or Judicial Services:

One of the most difficult examination in our country is to crack is civil service examination, but even civil service official have excepted that law students have an edge compared to other student coming from other stream. Thus a law student can prepare for this exam in much better way because those subject included in the examination is part of their syllabus in law academy. They are well-versed with current affairs of National & world wide.

4. Jobs with NGOs:  taking law as a course can enhance your personality and develop social responsibility toward society at large. few students at present in their final year must be willing to work for the social service or other related matter, present scenario in respect of social worker is completely different, its value is no less than other alternative . infact capital consideration is small it is looked upt, fame prospective since you may emerge at the nationwide or international stage. A s a student of law gives you wide range for these kind of  similar jobs. .our Indian society has expanded over the last 20 years, with has led to creation of multiple job in different NGO. Top NGO give their first preference to student of law, as they are familiar with law of the land as well having good research skill.

5.legal teacher/trainee:

As the education sector in our country is rising at such a fast speed , Law shcool/university have to face huge shortage of high-quality legal/trainee  teachers. It is because of this that it has led to an enhance in the salary and emolument simultaneously. Furthermore, there are huge amount  of administrative employment in this division. Young law graduates once they are over with their LLB/ masters can also look ahead as a teacher in this field.

There are also a number of new arena that are emerging up for legal experts, and there is no  scarcity of takers for excellent lawyers in any of the subsequent       domain:

Social Law:  Main purpose of law is to render righteousness and justice,  the public who need justice and equity are the ones who in fact can’t aid themselves are not able to help themselves. There is increasingly a small group of student and teachers in each and every law school, these students and teachers  who want to make a atleast a minute difference to the life of the oppressed deprived citizen, and hence university has taken initiative and responded to the need of humanity to organize young lawyers with skills, quality needed to be successful everywhere from each and every in the world NGOs to the  different organ United Nations dedicated for this purpose.

·         Media and Law: Reporting is a predictably admired alternative for dynamic smart lawyers. Whether it political aspect or world interaction problem with our environment, finance advice or even news sports world! The fundamental skill which is required to stand out as a journalist – demands for detail, research work, ,good content quality writing - have common characteristics with law as domain and with just a bit of hard work  you could be advancing for a career in a domain of your interest.

·         Business Management: Huge number of global marketing and business men’s have a degree in Law,. Having a degree in the field of law does not mean end of education. Law teaches us that numeral skills which are relevant across each and every domains and prepared with our lawful skill, a get into Business administration, by doing let say MBA, or by getting through any job directly in the financial division are not unknown options

·         Legal Process Outsourcing: Receiving legal aid in a most of country is a extremely costly proposal, and along with the new demand of the varying economy legal sectors are looking to cut costs by ephemeral(passing) on part of their work to cheap destination. In  our country with a large number of lawyers who can speak and write well in English is chosen for an LPO upheaval that will witness a huge demand for legal service.

·

Conclusion

Law as an, area of study has reoriented itself, It has massive prospective to absorb cerebral, hard working and ambitious, smart lawyers. Any student who desires to have all the option open I front of him after the successful completion of schooling can opt for law. Studying law at a good law institute enrich your character; makes you a vivacious, confident and an responsive citizen. Just to wrap up, I would state that any field can bear out to be a disappointment for you if you fail to work hard and develop interest. Teachers, parents or http://lawasprofession.blogspot.in/ don’t possess any magic crew to make it work or put in effort for you; it’s only you who can help him/herself.
